The European Cosmetics Regulation (CE No. 1223\/2009) prohibits or limits the use of certain substances in order to protect public health. Chemical products, colorants, preservatives\u2026 The main provisions are set out in Chapter IV of the regulation, and in particular in Article 15, which prohibits the use of substances classified as CMR (carcinogenic, mutagenic or reprotoxic) in cosmetic products.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The complete lists can be found in annexes II and III of the document:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Prohibited substances:<\/strong> Heavy metals, gases, hydrocarbons, toxic chemicals\u2026 more than 1300 substances are completely prohibited. They are specified in Annex 2 of the regulation. \u00a0<\/li>\n\n\n\n<li><strong>Restricted substances:\u00a0<\/strong>listed in Annex III, these substances are authorised under certain conditions only (maximum concentration, warning labels, etc.)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Before its commercialization, it will therefore be essential and imperative to check each ingredient with your supplier or the composition house, especially to ensure that no prohibited substance is included in the formula.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Source that can be easily consulted:<\/strong><br><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/FR\/TXT\/?uri=CELEX%3A32009R1223\">Regulation EC No. 1223\/2009 (EUR-Lex)<\/a><\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-regle-n-2-respecter-les-regles-d-etiquetage\" class=\"wp-block-heading\">Rule #2: Follow the labeling rules<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"isPasted\">The label of a perfume marketed in the European Union must meet specific requirements. When a product has been notified on the CPNP, it is not necessary to proceed with another notification at the national level.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You will be required to provide the following information in particular:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The category of the cosmetic product and its name or names, in order to allow its specific identification;<\/li>\n\n\n\n<li>The name and address of the person responsible for the product;<\/li>\n\n\n\n<li>The country of origin in the case of import;<\/li>\n\n\n\n<li>The Member State in which the cosmetic product is to be placed on the market;<\/li>\n\n\n\n<li>The contact details of a natural person to contact in case of need;<\/li>\n\n\n\n<li>The presence of substances in the form of nanomaterials;<\/li>\n\n\n\n<li>The presence and the name of substances classified as carcinogenic, mutagenic or toxic for reproduction (CMR)\u00a0<\/li>\n\n\n\n<li>The framework formulation allowing prompt and appropriate medical treatment in the event of disorders.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Useful source:<\/strong><br><a href=\"https:\/\/single-market-economy.ec.europa.eu\/sectors\/cosmetics\/cpnp_fr\">Easy guide on the CPNP portal<\/a><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-regle-n-4-constituer-un-dossier-dip-dossier-information-produit\" class=\"wp-block-heading\">Rule #4: Create a DIP (Product Information File)<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"isPasted\">The <strong>DIP<\/strong> (Product Information File) is a key document in regulatory compliance, intended to prove that the perfume placed on the market complies with the various standards. It must be kept available to health authorities for 10 years after the product was last marketed. It must be compiled with the utmost care: in fact, an incomplete or missing DIP can lead to a recall of the product or even administrative sanctions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This dossier includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The <strong>Report on the safety of cosmetic products<\/strong>, written by a qualified security evaluator,<\/li>\n\n\n\n<li>The <strong>test results<\/strong> (stability, compatibility, skin compatibility, challenge test, etc.),<\/li>\n\n\n\n<li>The description of <strong>manufacturing process<\/strong>,<\/li>\n\n\n\n<li>The <strong>marketing claims<\/strong> justified (e.g.: \u00ablong-lasting\u00bb, \u00abwithout allergens\u00bb).<br><\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-regle-n-5-designer-une-personne-responsable\" class=\"wp-block-heading\">Rule #5: Appoint a \u00abresponsible person\u00bb<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"isPasted\">Every perfume that is put on the market in Europe must have a <strong>Person Responsible (PR)<\/strong>, clearly identified. This person (whether moral or physical) has the mission to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>guarantee compliance<\/strong> from the product to the CE Regulation 1223\/2009,<\/li>\n\n\n\n<li>to ensure the <strong>traceability<\/strong> of the product,<\/li>\n\n\n\n<li>manage any adverse effects (cosmetovigilance),<\/li>\n\n\n\n<li>perform the <strong>Product recalls<\/strong>, If necessary.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">She can be the manufacturer, the importer or a representative and must be listed on the packaging with her contact details. In the event of a dispute, she must be held legally liable and responsible.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-regle-n-6-faire-une-veille-reguliere-sur-les-nouvelles-regles\" class=\"wp-block-heading\">Rule #6: Keep up to date with the latest rules<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"isPasted\">Like all regulations, that on perfumes and cosmetics is constantly evolving, in line with new scientific discoveries and health concerns.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Des <strong>substances<\/strong> What is allowed today may be banned tomorrow (endocrine disruptors, allergens\u2026).
